Abstract

For the first time in the legal literature, the article analyzes realistic and relativistic approaches to understanding and cognition of the truth in criminal proceedings, under the influence of which the Russian criminal procedure legislation and the theory and practice of criminal proceedings based on it are developing, in order to determine the nature of the problem and the methodology of its research using the methodology of system analysis.: 1) which of these approaches allows you to effectively solve problems? 2) which of these approaches corresponds to the imperatives formed in the process of evolutionary development of the human race Homo Sapiens common sense and public humanistic conscience, the spiritual products of which are the democratic principles of modern criminal justice? 3) is not a relativistic approach to the understanding and knowledge of the truth, which is based on the current code of criminal procedure, a deterministic source of social chaos in the current criminal procedure law and based on it the theory and practice of criminal justice? 4) how justified the desire of scholars and practitioners who adhere to a relativistic approach to the understanding and the knowledge of the truth in criminal proceedings, to send "the dustbin of history" principle and the concept of objective (material) truth?
