Abstract

The development of relations between the Canadian government and indigenous people in terms of legal norms is an indicator of the evolution of views on colonial policy. One of the first basic legal documents governing Aboriginal life was The Royal Proclamation of 1763. Even early partnerships between colonial authorities and indigenous groups were formed on the basis of agreements concluded between the parties. The treaties form the backbone of the relationship between the crown and the indigenous population.

The Indian Act of 1876 became an instrument of governance for indigenous peoples; it incorporated federal and provincial statutes. Having undergone a number of amendments, the law is still in effect. Although Indian law is discriminatory, the identity of the indigenous population has been placed on a firm legal basis.

The policy of the Canadian authorities was aimed at assimilation until the 70s; however, after the release of the so-called "White Paper", the struggle of the indigenous population to expand their rights began.

Historical treaties have been replaced by the "era of the modern treaty." Today, Canada's approach to treaty negotiation is changing as a result of changes in indigenous legislation from a policy of suppression and assimilation towards cooperation and respectful dialogue.
